MEDIATION IS AN ALTERNATIVE DISPUTE RESOLUTION METHOD WHERE A THIRD NEUTRAL PARTY HELPS CONFLICTED PARTIES TO OPEN DIALOGUE AND FIND THE BEST SOLUTION FOR THEIR PROBLEM
All parties need to be satisfied with the selected solution if mediation is to end with an agreement. Everybody wins and nobody loses.
Mediation is based on the conviction that the parties in conflict know best what the problem is, which solutions could satisfy their needs and interests, and which, from the suggested solutions, is best for them , simplest and easiest to implement. We all, sometimes, need help to be able to express our thoughts and enter dialogue in a situation when conflict escalated or brings about intense emotions, which makes communication difficult.
Therefore, in mediation:
- the solution is always based on interests of parties in conflict (not on power or right)
- only parties in conflict have the power of suggesting and deciding on solutions
- responsibility for the agreement and its implementation lies with the parties in conflict
Mediators ensure safe and confident space. They use communication and conflict analysis skills to help parties in conflict to:
- express their view of the problem and hear the view of the other party
- express their interests and needs and hear interests and needs of the other party
- jointly test all solutions suggested during the process
- decide on the solution that suits all parties in conflict
Parties in conflict are accountable for implementation of agreement unless a notary public certifies the signatures on the agreement. In that case, the settlement agreement has the effect of an enforceable document.

Community policemen and judges who participated in the training for mediators know which conflicts and disputes are suitable for mediation. They can give you information about mediation processes, benefits, advantages and main characteristics and they can give you information where you can apply for mediation services in Osijek .
Advantages of mediation
- mediation is voluntary, non-binding and free of charge
- citizens can quickly and effectively solve their disputes
- the number of possible solutions is much higher in relation to court proceedings
- parties in conflict are in control of the process and solutions, which eliminates the danger of dissatisfying solutions
- agreement reached by mediation satisfies interests of all parties and thereby can contribute to the quality of their future relationship and open possibilities of future cooperation.
- develops culture of listening, dialogue and creative conflict resolution - Parties change their attitude towards conflict because they have experienced that it is possible to find solutions that satisfies them all By participating in the process they learn how to deal with future conflicts, even without the help of a third, neutral party.
Disputes that are suitable for mediation are all disputes in which parties can freely decide on the outcome (solution) - all disputes that can be solved by an agreement between parties in conflict are:
- neighbour disputes
- family disputes
- disputes within the workplace
- conflicts about property and damages
- public disturbance conflicts
- conflicts between parents and teachers
- conflicts between students and teachers
- conflicts among peers and many others.
Who are our mediators?
Centre for Peace - Osijek is finishing a two-year programme of education of mediators and introducing mediation as a service in Osijek , Beli Manastir and Vukovar.
Models of mediation that are being used in other countries are adapted for our local conditions and needs of the three local communities. Experts in the field of law and mediation, police and judiciary and local authorities participate in the process.
During last two years 29 community policemen, 12 judges and 60 citizens from Osijek , Beli Manastir and Vukovar received training for mediators;
Mediators:
- participated in the training that consists of 8 days of training, practical work (facilitation of mediation process), individual and group supervision with local experts and supervision with mediation expert from Great Britain (Barbara Mitchels).
- possess the experience of co-mediation with an experienced mediator.
- signed Code of Conduct (Croatian) for mediators
