On 17 December 2010, the main hearing began at the Zagreb County Court in the case of Željko Gojak, charged with a war crime against civilians - a murder of three members of the Roknić family.

On 28 February 2012, the Zagreb County Court\'s War Crimes Council rendered a verdict in which it found defendant Željko Gojak guilty for war crime against civilians which he committed by killing minor Danijela Roknić and injured party Dragica Ninković. He was sentenced to 9 years in prison.

On 16 May 2013, the Supreme Court of the Republic of Croatia (VSRH) rejected as unfounded the appeals lodged by the State Attorney and by the defendant and confirmed the first-instance verdict.

On 1 December 2009 at the Karlovac County Court, the defendant Mićo Cekinović was found guilty of committing a war crime against civilians referred to in Article 120, paragraph 1 of the Basic Criminal Law of the RoC (hereinafter: the OKZ RH). He was sentenced to one year in prison.
The Supreme Court quashed the Karlovac County Court\\\'s Verdict.
In the repeated trial, the Karlovac County Court\\\'s War Crimes Council found on 4 May 2010 the defendant Cekinović guilty and sentenced him to 4 years in prison.
The session of the Supreme Court of the Republic of Croatia was held on 27 October 2010. The Supreme Court quashed the first instance verdict. After the third (second repeated) hearing held on 23 December 2011, the Rijeka County Court\'s War Crimes Council found the defendant guilty and sentenced him to 4 years in prison. The VSRH Appeals Chamber held its session on 30 January 2013. It confirmed the first-instance verdict.

On 8 April 2009, the Osijek County Court found the defendant Čedo Jović guilty and sentenced him to 5 years in prison for the criminal act of war crime against civilians referred to in Article 120, paragraph 1 of the Basic Criminal Law of the Republic of Croatia (OKZRH). On 12 November 2009, the Croatian Supreme Court quashed the first instance verdict of the War Crimes Council of the Osijek County Court. On 18 February 2010, after the conducted repeated trial, the War Crimes Council of the Osijek County Court once again pronounced the defendant Čedo Jović guilty and sentenced him to 5 years in prison.
The session of the Supreme Court of the Republic of Croatia was held on 13 October 2010. The Supreme Court of the Republic of Croatia quashed the 18 February 2010 Verdict of the Osijek County Court and reversed the case to the first instance court for a retrial. On 15 March 2011, after the conducted repeated trial, the War Crimes Council of the Osijek County Court once again pronounced the defendant Čedo Jović guilty and sentenced him to 5 years in prison. After the fourth first-instance trial, on 1 June 2012, the defendant was found guilty again and sentenced to 5 years in prison.

The session of the Supreme Court of the Republic of Croatia was held on 20 February 2013. The Osijek County Court\'s verdict of 1 June 2012 is confirmed.

On 16 February 2010, the main hearing commenced before the Sisak County Court in the trial against Pero Đermanović, Ljuban Bradarić, Dubravko Čavić and Ljubiša Čavić, who were indicted for committing in 1991 in the villages Stubalj, Graboštani, Gornji and Donji Hrastovac a war crime against civilians under Article 120, paragraph 1 of the OKZRH.
On 23 April 2010, the first instance verdict was pronounced against the defendants finding them guilty and sentencing them to prison: Pero Đermanović (11 years), Ljuban Bradarić (1 year), Dubravko Čavić (9 years) and Ljubiša Čavić (2 years). The session of the Supreme Court of the Republic of Croatia was held on 22 December 2010. Supreme Court of the Republic of Croatia quashed the verdict of Sisak County Court. The VSRH quashed the first instance verdict in the case of defendants Đermanović and Dubravko and Ljubiša Čavić. As for defendant Bradarić, the first instance verdict was confirmed. After the repeated trial, the Zagreb County Court\\\'s War Crimes Council found the defendants guilty and sentenced them to the following prison sentences: Pero Đermanović (9 years), Dubravko Čavić (7 years) and Ljubiša Čavić (2 years).
The VSRH Appeal Chamber at its session held on 5 September 2012 quashed the verdict and remanded the case back to the first-instance court for a retrial.

On 26 March 2013, the Zagreb County Court\\\'s War Crimes Council pronounced the verdict in which defendants Đermanović, Dubravko Čavić and Ljubiša Čavić were found guilty and sentence to the following prison sentences: Đermanović (9 years), Dubravko Čavić (7 years) and Ljubiša Čavić (2 years).

On 17 January 2001, the main hearing began at the Zadar County Court in the case of Nikola Munjes who was previously (in 1995) sentenced in absentia to 9 years in prison for a war crime against civilians under Article 120, paragraph 1 of the OKZRH, committed in Perušić in September 1991. On 4 February 2011 at the Zadar County Court, defendant Nikola Munjes was sentenced to 9 years in prison. The VSRH quashed the Zadar County Court\'s judgment. The case was then transferred to the Spilt County Court. After the repeated proceedings, on 30 November 2012 the County Court Split\'s War Crimes Council found the defendant Munjes guilty and sentenced him to 5 years in prison. The session of the Supreme Court of the Republic of Croatia was held on 20 February 2013. The VSRH upheld the first instance verdict.

Crime in Maja and Svračica

On 13 November 2009, before the Sisak County Court, following the conducted re-opened procedure, the defendant Milan Španović was found guilty and sentenced to 3 years and 5 months in prison for a war crime against civilians. In 1993, he was sentenced in absentia to 20 years in prison. On 28 September 2010, the session of the Council of the Croatian Supreme Court was held. The 13 November 2009 verdict reached by the War Crimes Council of the Sisak County Court was quashed and the case was reversed for a retrial. After repeated proceedings at first instance, the Zagreb County Court\'s War Crimes Council pronounced the verdict on 14 March 2013. With this verdict, the court has abrogated the prior final verdict, rendered by the Sisak County Court on 17 November 1993 in which the defendant was found guilty and sentenced to 20 years in prison, and rendered the acquittal.

On 23 September 2010, a trial against the accused Željko Belina, Dejan Milić, Ivan Grgić and Zdravko Plesec, former members of the Croatian Army charged with war crime against civilians committed by killing Goranka Mileusnić, Vera Mileusnić and Blaženka Slabak and wounding of Petar Mileusnić in Novska in December 1991, commenced at the Sisak County Court.
On 19 November 2010, the Sisak County Court\\\\\\\' War Crimes Council rendered a judgement rejecting the charge pursuant to Article 353, item 5 of the Criminal Procedure Act because it held the view that this was a res iudicata case i.e. that the matter was already judged. The VSRH quashed the first instance verdict rejecting the charge in respect of the 1st defendant Belina and the 2nd defendant Milić. The first instance verdict was confirmed in respect of defendants Ivan Grgić and Zdravko Plesec. The repeated first instance proceedings in respect of defendants Željko Belina and Dejan Milić will be conducted at the Zagreb County Court. After the repeated trial, the Zagreb County Court\\\\\\\'s War Crimes Council found the defendants guilty on 8 March 2013. Belina was sentenced to 10 years, and Milić to 9 years in prison.

On 8 March 2010, the main hearing began at the Sisak County Court in the trial against Vide Damir Raguž and Željko Škledar, indicted for committing a war crime against civilians in Novska on 21 November 1991.
On 16 April 2010, the defendant Vide Damir Raguž was found guilty by the first instance verdict and he was sentenced to 20 years in prison, whereas the defendant Željko Škledar was acquitted of charges. The session of the Supreme Court of the Republic of Croatia was held on 10 July 2012. Supreme Court of the Republic of Croatia quashed the verdict of Sisak County Court. On 7 February 2013, the Zagreb County Count rendered the first-instance verdict in which Damir Vid Raguž and Željko Škledar were acquitted of the charges.

On 29 April 2009 at the Vukovar County Court, criminal proceedings against defendants Milan Tepavac and Ilija Vorkapić - who attend the trial - was separated from the proceedings against the following defendants who are not available to Croatian judiciary: Ljuban Devetak, Milan Devčić, Milenko Rudić, Željko Krnjajić, Slobodan Zoraja, Željko Brajković, Ilija Kresojević, Milan Rendulić, Obrad Tepavac, Zoran Tepavac, Milan Tepavac, Milan Radojčić, Milan Vorkapić, Dušan Grković and Đuro Prodanović.
In December 2010, the Tepavac case was separated from the Vorkapić case due to the incapability of Tepavac to stand trial. On 2 February 2012, the first-instance verdict was rendered in which defendant Vorkapićs was acquitted. The VSRH Appeals Chamber at its session held on 28 November 2012 rejected the appeal by the State Attorney and confirmed the verdict rendered by the first-instance court.

On 20 December 2010, the War Crimes Council of the Sisak County Court found the defendant guilty. He was sentenced to 8 years. On 12 July 2011, the VSRH\\\\\\\'s Appeals Chamber quashed the Sisak County Court\\\\\\\'s first instance verdict due to major violations of the criminal procedure provisions and remanded the case for retrial. On 17 April 2012, after the repeated first-instance trial, the Zagreb County Court\\\'s War Crimes Council found the defendant guilty and sentenced him to 6 years in prison.

On 31 January 2011, the main hearing began at the Šibenik County Court in the case of Goran Amanović, indicted for committing in the Promina area (Suknovci and Oklaj) a war crime against civilians under Article 120, paragraph 1 of the OKZRH. On 20 May 2011, the War Crimes Council of the Šibenik County Court pronounced a verdict by which defendant Goran Amanović is acquitted of the charge of war crime against civilians. In the third (second repeated) trial before the Karlovac County Court, the defendant Mihajlo Hrastov was for the third time acquitted of charges that he had committed a criminal act of unlawful killing and injurying the enemy. The aforementioned trial was held on 2004/2005/2006/2007. Following the public session of the Supreme Court in September 2008, it was decided to hold a public session at the Supreme Court. Following the conducted public session, the Panel of the Supreme Court found the defendant Hrastov guilty and sentenced him to 8 years in prison. The Panel of the Supreme Court, at the session held on 24 November 2009, passed the third instance verdict which partially accepted the appeal lodged by the defendant Mihajlo Hrastov and altered the second instance verdict of the Supreme Court in the sentencing part in such a manner that the defendant was sentenced to 7 years in prison.
The Constitutional Court quashed the convicting verdicts of the Croatian Supreme Court and reversed the case for a retrial but to be conducted by a completely altered council. The VSRH held its session on 5 October 2011. After the hearing, the VSRH Council pronounced on 7 September 2012 the ruling by which it accepted the prosecution\'s appeal and amended the acquitting verdict rendered by the Karlovac County Court. The VSRH found defendant Hrastov guilty for a criminal act of unlawful killing and wounding the enemy and sentenced him to 4 years in prison.

The criminal proceedings were held before the War Crime Council of the Rijeka County Court against the defendant Željko Šuput and the defendant Milan Panić who are charged with a war crime against prisoners of war referred to in Article 122 of the Basic Criminal Law of the Republic of Croatia (hereinafter: the OKZ RH). On 3 October 2008, a non-final verdict was published in which the defendants were found guilty and sentenced to prison terms (the defendant Šuput in the duration of 4 years, while the defendant Panić in the duration of 3 years and 6 months. At the session held on 8 June 2011, the VSRH accepted the defendants´ appeals, quashed the challenged verdict and remanded the case for retrial to the Rijeka County Court. Repeated trial began on 25 October 2011. On 26 April 2012, the prosecution amended the legal qualification of the criminal offence according to which the defendants are now charged with a war crime against civilians and not any more with a war crime against prisoners of war. On 12 June 2012, the Rijeka County Court\\\'s War Crimes Council pronounced the verdict in which the defendants were found guilty. Same as in the first-instance proceedings, they were sentenced to the following prison terms: Šuput (4 years) and Panić (3 years and 6 months).

The renewed first-instance proceedings against eight defendants, members of the Military Police of the Croatian Army, tried for the criminal act of war crime against civilians in the \\\"Lora\\\" Military Investigative Centre, was completed before the County Court in Split. The first-instance convicting verdict containing prison sentences in the range between 6 and 8 years was reached on 2 March 2006. The Supreme Court of the Republic of Croatia upheld the verdict which became final on 6 February 2007. The repeated trial was conducted in absence of the defendants Tomislav Duić, Miljenko Bajić, Josip Bikić and Emilio Bungur who were fugitives from justice. On 29 December 2009, the trial against Josip Bikić was reopened. Previously, he had been sentenced with a legally binding verdict to 6 years in prison. In the reopened trial, he was sentenced to four years of imprisonment. On 14 May 2012, the trial against Miljenko Bajić has been reopened. Previously, he had been sentenced in his absence to 6 years in prison. In the reopened trial, he was sentenced to 4 years and 6 months in prison.

The main hearing began on 13 April 2010 at the Vukovar County Court in the trial against Miloš Stanimirović and another fourteen persons. The defendants were charged that following 20 September 1991 in Tovarnik they were displacing, killing, mentally torturing Croat and non-Serb civilian population and were seizing or destroying their property. Thus, they committed criminal offences against humanity and international law - a genocide as described and punishable according to Article 119 of the OKZRH and a war crime against civilians as described and punishable according to Article 120, paragraph 1 of the OKZRH by applying Article 43 of the OKZRH.

The indictment was amended on 10 April 2012. According to the amended indictment, eleven defendants are charged with a war crime against civilians, and three defendants are charged with armed rebellion. Criminal proceedings were discontinued in respect of one female defendant who died.

A third trial (second repeated) against Petar Mamula accused for committing a war crime against civilians pursuant to Article 120, paragraph 1 of the OKZRH began on 18 March 2009 before the War Crimes Council of the Osijek County Court.
This Court announced the verdict on 7 April 2009 which found the defendant guilty and sentenced him to a prison term in duration of 4 years and 10 months.
The public session of the Supreme Court of the Republic of Croatia (VSRH) was held on 3 August 2010. Supreme Court of the Republic of Croatia quashed the verdict of Osijek County Court and reversed the case for re-trial.
The main hearing in the fourth (third repeated) trial began on 22 February 2011.
On 23 March 2011, the War Crimes Council of the Osijek County Court found defendant Petar Mamula guilty and sentenced him to 3 years and 6 months in prison.  The VSRH held its session on 12 October 2011. We are not yet familiar with its decision. After the fifth (fourth repeated) main hearing held on 10 February 2012, the defendant was found guilty and sentenced to 3 years and 6 months in prison.

On 20 September 2010, a trial against Božidar Vukušić commenced at the Šibenik County Court. Vukušić was charged that he, in his capacity as member of the Croatian Army, killed the civilian Jovan Ergić on 29 December 1991, thus committing a criminal offence of war crime against civilians. On 22 September 2010, the verdict was announced which found the accused guilty. Vukušić was sentenced to 9 years of imprisonment.

After the repeated trial was completed, on 10 June 2010 the defendant was found guilty and sentenced to 9 years of imprisonment.

Following the permission to re-open criminal proceeding in which the defendants Zoran Lakić, Marko Lacmanović, Rajko Radmanović, Zoran Radmanović, Bogdan Repaja and Drago Repaja were sentenced for a war crime against civilians, and after amendment of the indictment, the trial against the mentioned defendants was discontinued by way of applying the provisions of General Amnesty Act.

Although the main hearing before the Sisak County Court in the Milan Velebit case was scheduled for 7 June 2010, it did not begin. The defendant resides in the Republic of Serbia and is its citizen. He was summoned to attend the hearing but did not come.

The main hearing of the trial against the accused Bogdan Kuzmić commenced before the War Crime Council of the Vukovar County Court on 07 April 2008. Bogdan Kuzmić was accused of criminal act of war crime against civilians, stated in Article 120, Paragraph 1 of the Basic Penal Law of the Republic of Croatia, which had been committed in the Vukovar Hospital on 19 November 1991.
On 15 July 2010, Bogdan Kuzmić was pronounced guilty. The verdict is not legally valid yet. Bogdan Kuzmić was sentenced to 7 years of imprisonment.

The main hearing in the criminal proceedings against the defendant Nenad Pejnović for a war crime against civilians, described and punishable pursuant to Article 120 paragraph 1 of the Basic Criminal Law of the Republic of Croatia (hereinafter: the OKZ RH) commenced on 24 February 2009 before the Karlovac County Court.
The first instance verdict was pronounced on 3 April 2009. The defendant received a prison sentence in the duration of 6 years. The Supreme Court upheld entirely the verdict of the Karlovac County Court War Crimes Council.

Crime in the Corridor, in Potkonje, Vrpolje and Knin

On 7 May 2009, following the repeated proceedings, the verdict of the War Crime Council of the Šibenik County Court was published, which found the defendants Milan Atlija and Đorđe Jaramaz guilty. The defendant Atlija received a joint prison sentence in the duration of 14 years, while the defendant Jaramaz was sentenced to 10 years in prison.
The Supreme Court at the session of the Council held on 25 November 2009 altered the verdict of the War Crimes Council of the Šibenik County Court. It determined prison sentences in the duration of 8 years to each of the defendant for the criminal act under Article 120, paragraph 1 of the OKZRH (whereas the first instance court determined 10 years). Considering the fact that the defendant Milan Atlija had already been previously sentenced to five years in prison, he received a joint prison sentence in the duration of 12 years.

Crime in Popovac

The repeated procedure against Stojan Pavlović, Đuro Urukalo and Branko Berberović was concluded at the Osijek County Court. On 7 July 2009, the first instance verdict was pronounced in which the defendant Stojan Pavlović was sentenced to 3 years in prison, the defendant Đuro Urukalo to 2 years in prison and the defendant Branko Berberović to 1 year and 6 months in prison for the commission of a war crime against civilians referred to in Article 120, paragraph 1 of the Basic Criminal Law of the RoC (hereinafter: the OKZ RH) in the village of Popovac in Baranja area in the period between August 1991 and the end of 1996.
The Supreme Court at its session held on 9 February 2010 upheld the verdict of the first-instance court.

Trial against Rahim Ademi and Mirko Norac accused for the criminal offence of a war crime against civilian population and a war crime against war prisoners committed in the Medak Pocket in 1993. This trial was conducted before the War Crimes Council of the Zagreb County Court. It started on 18 June 2007. A verdict before appeal (the non-final conviction) was announced on 30 May 2008.
The Supreme Court's public session was held on 16, 17 and 18 November 2009.

The proceedings against Ranko Pralica and Stanko Palančan, who were validly sentenced in 1993 in absentia to 20 years in prison for a war crime against civilians and a war crime against war prisoners, was re-opened at the Sisak County Court.

Following the re-opening of the proceedings, the prosecution attorney abandoned criminal prosecution.

In the re-opened procedure against the absent defendants Luka Ponorac, Luka Nikodinović, Miodrag Simeunović and Rajko Dreković, a ruling was passed on 13 July 2009 which, pursuant to the General Amnesty Act, terminated the criminal procedure against the aforementioned persons.

The Supreme Court of the RoC established that the request for protection of legality filed by the State Attorney's Office was well-founded and that the legally valid verdict of the Sisak District Court No. K-24/92 of 25 May 1993 and the verdict of the Supreme Court of the RoC No. I Kž 833/93 of 30 November 1993 violated the law to the detriment of the convicts Nikola Radišević, Jovo Zubanović, Simo Plavljenić and Dušan Paunović, thus it quashed the abovementioned verdicts and reversed the case to the first instance court for a re-trial.
After the State Attorney's Office dropped charges, on 7 January 2010 the Court suspended criminal proceedings against Radišević, Zubanović, Plavljenić and Paunović.

Crime in Mikluševci

On 5 February 2009, the War Crimes Council of the Vukovar County Court announced the verdict wherein 12 defendants were found guilty of committing war crime against civilian population referred to in Article 120, paragraph 1 of the OKZ RH and sentenced them to prison terms, and two defendants were acquitted of charges that they had committed genocide referred to in Article 119 of the OKZRH. Three defendants were present at the court when the verdict was announced. Other defendants are at large and they were tried in absentia.
The Supreme Court of the Republic of Croatia entirely upheld the first-instance court verdict.

On 20 May 2009, the War Crimes Council of the Sisak County Court, in the re-opened procedure against the absent defendants Dragan Roksandić and Milan Korač, after the Sisak County State's Attorney's Office (hereinafter: the ŽDO) modified the indictment no longer charging the defendants with committing a war crime against civilians but with the criminal act of armed rebellion, passed the verdict which annulled the legally valid verdict of the Sisak District Court No. K-21/93 of 26 May 1993 in which both defendants were found guilty and sentenced to 20 years in prison and, pursuant to the General Amnesty Act, it rejected the indictment.

Crime in Cerna

On 14 February 2008, the Vukovar County Court announced a verdict of guilty in the trial against the defendants Tomislav Madi, Mario Jurić, Zoran Poštić, Davor Lazić and Mijo Starčević for committing a war crime against civilians pursuant to Article 120, paragraph 1 of the OKZRH. This criminal offence was committed on 17 February 1992 in Cerna by killing the Olujić family. The following prison sentences were pronounced to the defendants: 20 years to Madi; 12 years to Jurić, 8 years to Poštić, 7 years to Lazić and 10 years to Starčević. The public session of the Croatian Supreme Court was held on 25 March 2009. The sentence in respect of Jurić and Lazić was upheld but it was reduced in respect of the other defendants so that Madi was sentenced to 15, Poštić to 7 and Starčević to 8 years of imprisonment.

The Sisak County Court, in the re-opened proceedings against Petar Baltić and ten other persons validly sentenced in 1993 in absentia to 20 years in prison each for a war crime against civilians and a war crime against war prisoners, after the prosecution dropped charges, annulled the previous (convicting) verdict and passed the verdict in which the indictment was suspended.

Crime in Branjin Vrh

The trial against the defendant Vaso Petrović et al. for the criminal act of genocide is held before the War Crime Council of the Osijek County Court pursuant to the indictment No. KT-123/96 dated 7 May 1996.

The trial against the defendants Goran Čuljak, Slavko Kecman and Branko Tomić was separated. In the modified indictment dated 30 December 1996, the factual description of the criminal act, legal aspects and legal qualification of the act were changed. After that, the procedure against Goran Čuljak, Slavko Kecman and Branko Tomić was quashed.

The procedure against other defendants is on hold until they become available to the judiciary of the Republic of Croatia. The Supreme Court of the Republic of Croatia has made a recommendation not to conduct trials of the defendants in absentia.

Crime in Borovo Commerce

In the ruling No. K-58/05 of 4 December 2008, the criminal procedure No. K-58/05 conducted before the Vukovar County Court against the defendant Vlado Tepavac for a war crime against civilians referred to in Article 120, paragraph 1 of the Basic Criminal Law of the RoC (hereinafter: the OKZ RH) was suspended. Previously, the Vukovar County State's Attorney's Office (hereinafter: the ŽDO) filed a submission on 21 November 2008 in which it changed the factual description, legal description and legal qualification of the criminal act (into the criminal act of armed rebellion). By applying the provision of Article 2, paragraph 2 of the General Amnesty Act, the procedure against the defendant was suspended.

Criminal procedure was conducted before the War Crimes Council of the Zagreb County Court against the defendant Slobodan Davidović, member of the paramilitary unit "Scorpions", charged with a war crime against civilians in 1995 in Trnovo (execution of six civilians) and a war crime against war prisoners in 1991 in Bobota. The defendant was validly sentenced and is currently serving a prison sentence in the duration of 15 years.

The War Crimes Council of the Gospić County Court repeated the trial (namely the Croatian Supreme Court, by way of decision No. I Kž 423/05 of 21 December 2006 accepted the appeal by the State Attorney and quashed the first-instance not-guilty verdict returning the case to the first-instance court for a new trial) against Nikola Cvjetićanin, accused for committing a criminal act - a war crime against civilians in the village of Smoljanac, the Plitvička jezera municipality, on 8 October 1991. On 23 January 2008, the verdict was announced by which the defendant was acquitted of charges.

On 19 July 2007, at the Vukovar County Court, the defendants Živko Opačič and Milan Bjedov were non-validly acquitted of charges for a war crime against civilians referred to in Article 120, paragraph 1 of the Basic Criminal Law of the Republic of Croatia (hereinafter: the OKZ RH).

The Supreme Court of the RoC, at the session of the Panel held on 10 December 2008, terminated the criminal proceedings against the defendant Opačić (deceased on 12 October 2007), and rejected the appeal lodged by the State's Attorney's Office against the defendant Bjedov and upheld the acquitting verdict of the Vukovar County Court.

The Supreme Court of the RoC, at the session of the Panel held on 28 January 2009, rejected the appeals and upheld the verdict of the War Crime Council of the Sisak County Court, passed in the repeated proceedings, which found the defendants Janko Banović and Zoran Obradović guilty of committing a war crime against civilians referred to in Article 120 paragraph 1 of the Basic Criminal Law of the Republic of Croatia (OKZ RH) and sentenced them to 5 years in prison each.

The 1st defendant Janko Banović is at large and he was sentenced in absentia. The 2nd defendant Zoran Obradović is in detention.
